1. Scope and general information

1.1 About us

Welcome to Film There. For the purposes of this Privacy Policy “Film There” is our platform, app and all their features, as well as our website and us (FILM THERE LTD) as the operator of the platform. For the purposes of data protection legislation, FILM THERE LTD of 91 Brick Lane, The Cooperage Building, London, United Kingdom, E1 6QL — Email: privacy@Filmthere.com — is the controller for the processing of your personal data. Film There has notified the Information Commissioner’s Office (“ICO”) of its processing of personal data. The notification indicates what data is processed by Film There and for what purpose, and to which persons or entities the data will be provided. Film There’s registration number is 0001510686. Film There allows you to find locations to shoot at, rent out your location and the possibility for various interactions with other users. Our Terms of Service and Privacy Policy apply to your usage of Film There. We explain in our Terms of Service how Film There works and which rules apply to Film There’s functions. We also explain to you in this Privacy Policy which personal and other data we process and how we protect your data. You can view our Terms of Service, Privacy Policy and Imprint at any time from your profile. If you have any questions or comments, please do not hesitate to contact us.

  • By “personal data” we mean all information that you can imagine about yourself by which you can be identified as a person or which, when combined together with other information we hold, can be used to identify you. This includes your name and contact details. Some of this data is required to provide you with certain features of Film There. In this Privacy Policy we explain what data we collect and how we use it.
  • You can rely on us to process your personal data in accordance with applicable law, including but not limited to the GDPR and Data Protection Act 2018.

2. Who we collect personal information about

We collect and process personal information from the following people:

  • Site users and visitors
  • Film There Members
  • Job applicants

This section describes what personal information we may collect and how we use it.

2.1 Data you supply (“Submitted Information”), which includes:

If you want to message a Host, request a location, create a Listing or use other features of Film There, you need to create a Film There account and create a profile. There are some features that you cannot use anonymously. To create a Film There account, you must register with your email address and password, or via your Facebook. Please make sure to enter your valid email address, or choose the log-in via Facebook and choose a secure password. You must keep your password safe, and change it at regular intervals. As soon as your Film There account is created, you must be willing to voluntarily enter certain mandatory and other voluntary information about yourself in the input fields. We rely on contractual necessity for the mandatory information as it is necessary for you to create an account and provide us with this information (e.g. profession) in order to be able to use the features of Film There. We rely on consent for the voluntary information as it is your choice as to whether to allow us to access such information or not.

Please note that we do not actively collect sensitive information (e.g. sexual orientation or political views) and suggest you do not submit any to Film There. As a general rule, any Submitted Information may be made public to other users. Therefore, please be careful, at all times, to enter only the information and content that you really want to share with other users or make public. If you enter any sensitive personal data, you explicitly consent, and we rely on such consent, to collect, store and process this information according to applicable data protection law.

You can, of course, always view, edit, or share with other users any information, or delete this information. If you want to change your name or e-mail address, you can do this in the settings.

Once you are logged in to Film There, you will be able to use the features of Film There. You may, however, have to provide us with certain additional details to use additional features, for example when you request a location. In this event, we will of course point out to you what further data we require. We rely on the legitimate interests processing ground to collect this information. It is in Film There legitimate interests to collect this information because this is necessary in order to provide these features of Film There to you. The items of personal data collected are limited and therefore not of a nature whereby your rights and freedoms as a data subject are outweighed by such data collection.

When you use Film There, we collect, store, and process all of your Submitted Information (whether it be the information that you must supply to us to use Film There, other voluntary information that you choose to submit to Film There, like your profession, etc.) to allow you to personalize Film There and for Film There to tailor Film There as appropriately as possible to you. In addition to your data and content, we will also collect information about your use of Film There (e.g., your requests a location or share a location) as well as your interactions with other Members.

We may use your name, email address or similar information to send you (or the organisation you represent) electronic marketing communications like newsletters. Our marketing communications may include information promoting Film There, as well as general information about us and the events and promotions we offer from time to time. We will only send you marketing mails if you explicitly give us your consent by using the tick-box when registering for Film There. You can at any time send us an email at privacy@Filmthere.com to withdraw your consent.

If you apply for a job with FILM THERE LTD whether through the Site or otherwise, we will collect and process your personal information in connection with your application.

If you contact us for questions or feedback, we will process the details of your request for follow-up queries. We rely on contractual necessity to process this information as we need this information in order to answer your question or respond to your feedback.

2.2 Data we collect includes:

When using Film There, in order to ensure that Film There can operate and to provide its features to you, the provider of your hardware may collect the following technical data. This data is automatically collected and transmitted to us from your device during your use of Film There (“Usage Data”) and includes: (i) device name (e.g. “Apple iPhone 8” or “MacBook Pro”); (ii) operating system and version; (iii) the version of Film There that you are using; (iv) system language; (v) general device data, such as voice and regional settings; (vi) IP address of the terminal; (vii) date and time of use; and (viii) application ID to identify your installation of Film There.

Film There may send error messages in the event of a crash (that is, after Film There has unexpectedly quit because of a program error or it has stopped responding to your input) to improve our service. The error messages contain information about which part of Film There software code has caused the error.

We use the Usage Data and, if applicable, the error messages, to enable Film There to function, to detect and correct any security risks or malfunctions and to ensure the stability of our systems. We rely on the legitimate interests processing ground to collect this information. It is in our legitimate interests to collect this information because this is necessary in order to secure Film There’s functionality, detect errors resolve them, and to help us to detect and prevent cyberattacks.

We may monitor your use of Film There through the use of cookies and similar tracking technologies. For example, we may monitor how many times you visit, which pages you go to, traffic data, in-app messages, requests, your IP and MAC address, a unique device identifier, the browsers and devices you use to access our Apps and Sites, your internet service provider, and the actions you take when using Film There (“Analytics”). Use of these technologies makes your use of Film There more streamlined, allows personalised advertising, improves the functionality of Film There and, for example, allow bookings. We rely on the legitimate interests processing ground to collect this information. It is in Film There’s legitimate interests to collect this information because this is necessary in order to provide and improve Film There. Please see also Section 8 “Cookies”.

If you use the Film There platform and open Film There for the first time, you will be asked if Film There is allowed to send push notifications. If you allow this feature, we will send you push notifications, for example, to inform you about your requests and bookings. Such push notifications are controlled by the software components of your operating system (so-called “tokens”). You can configure and turn our push notifications off via your device settings at any time. You can also select the exact notifications you would like to receive in Film There’s in-app settings.

If you download and install Film There from an App Store (such as Google Play or the Apple AppStore), you must first register with the provider of the respective App Store for a user account and enter into that App Store’s user agreement. We have no influence on the terms of such user agreement and are not a party to such user agreement. When downloading and installing Film There, certain information is transmitted to the respective provider of the App Store (e.g., Google or Apple), including your username, your email address and the customer number of your account, the time of download and the individual device code and, in the case of in-app purchases, your payment information. We have no influence on, and are not responsible for, this data collection. We only process data provided to us as necessary for downloading and installing Film There on your mobile device (e.g., your iPhone or Android device).

If you use the Film There App when you open Film There for the first time, you will be asked if Film There is allowed to access your location. If you allow this feature, we will determine your location to provide you with site-specific functions of Film There, like showing you locations that are close to you. You can configure and turn location settings off via your device settings at any time. We rely on consent to process this information as it is your choice as to whether to allow us to access such information or not.

If you want to use other features of Film There, such as your camera or photo and video upload function, you might be asked if you want to use this function before using it for the first time. If you allow any such feature, you can use the corresponding function to perform the desired interaction on Film There, like sharing photos of locations with the other Members. You can enable or disable access to these functions at any time via your device settings. We rely on consent to process this information as it is your choice as to whether to allow us to access such information or not.

We may review, scan, or analyze your communications on Film There for fraud prevention, risk assessment, regulatory compliance, investigation, product development, research, analytics, and customer support purposes. For example, as part of our fraud prevention efforts, we might access, scan and analyze messages to mask contact information and references to other websites. In some cases, we may also scan, review, or analyze messages to debug, improve, and expand product offerings. We use automated methods where reasonably possible. Also, we may need to manually review some communications, such as for fraud investigations and customer support, or to assess and improve the functionality of these automated tools. We will not review, scan, or analyze your messaging communications to send third party marketing messages to you, and we will not sell reviews or analyses of these communications.

These activities are carried out on Film There’s legitimate interest in ensuring compliance with applicable laws and our Terms of Service, preventing fraud, promoting safety, and improving and ensuring the adequate performance of our services.

We may use information that we collect about you from your interactions with Film There or with our communications to you to provide you with personalised advertising on social media channels operated by Facebook and/or Google where you are a registered user of such services. We do this using Facebook Customer Audiences and/or Google Customer Match respectively. Where your personal information is not in an anonymous form, it is in our legitimate interest to use your personal information for marketing purposes. We will only engage in social media remarketing where you have consented to us using your email address and sharing your email address in an encrypted format with Facebook and/or Google respectively for marketing purposes.

We may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this policy for as long as it is combined. We will only use information collected about you in accordance with the GDPR and in accordance with our capacity as the data controller.

3. Data processing — External services

For us to offer you all the functions of Film There, we use certain third party and external service providers. A transfer of the data collected by us takes place only if:

You have given explicit consent; disclosure is required to assert, exercise or defend legal claims and there is no reason to assume that you have a predominantly legitimate interest in refraining from passing on your data; we are required by law to disclose such data; or such disclosure is legally permissible and required in relation to contracts, or pre-contractual measures, related to our engagement with you, which are carried out at your request.

We may provide your personal data to them as follows:

3.1 Third-party organisations that provide applications/functionality, data processing or IT services:

If we pass on data to our service providers, data centers storing Film There and its associated databases, and IT service providers who maintain our systems, they are only permitted to use such data to fulfill their tasks. These service providers have been carefully selected and commissioned by us, are only allowed to process such data on our instructions and in accordance with our agreement with them and have appropriate technical and organizational measures to protect your rights. We also regularly monitor such service providers.

3.1.1 Amazon Web Services

We host Film There via our hosting partner AWS (Amazon Web Services, Inc., 410 Terry Avenue North, Seattle WA 98109, United States). We will provide AWS with the data that you have entered into your Film There account (whether it be the information that you must supply to us to use Film There, other voluntary information that you choose to submit to Film There or information we collect), as well as data (e.g., Facebook or Google integrations) from the services you use. This data is hosted by AWS on our behalf on an AWS server within the European Union, so we can provide Film There to you and other users. This data is not visible to AWS and does not allow AWS to draw conclusions about you and your usage behavior.

3.1.2 Heroku, a Salesforce Company

We use Heroku (Salesforce Tower, 415 Mission Street, 3rd Floor, San Francisco, CA 94105, USA) for database hosting. Heroku is a Salesforce service that provides us a cloud platform where we run code that performs some of the functionality on our Sites. We also use Heroku to store some User Data in Heroku’s database. We will provide Heroku with data that you have entered into your Film There account (whether it be the information that you must supply to us to use Film There, other voluntary information that you choose to submit to Film There or information we collect). This data is hosted by Heroku on our behalf on a Heroku server within the European Union. You can learn more about Heroku’s privacy policies at https://www.salesforce.com/company/privacy/.

3.1.3 Mailgun

We use Mailgun (Mailgun Technologies, Inc., 548 Market St. #43099, San Francisco CA 94104, United States) to generate automated emails (for example if you request a location). Mailgun collects your email address, Message Bodies, Message Metadata, Suppressions and Recipient Data.

3.1.4 OneSignal

If you permit, we will send you push notifications. For sending push-notification we use OneSignal’s service (OneSignal Inc., 2194 Esperanca Avenue, Santa Clara, CA 95054, USA). Depending on your permissions granted to Film There, the Data collected may also include precise location (i.e. GPS-level data) or WiFi information, apps installed and enabled on the User’s device. Film There uses identifiers for mobile devices (including Android Advertising ID or Advertising Identifier for iOS, respectively) and technologies similar to cookies to run the OneSignal service. The Data collected may be used by the service provider for interest-based advertising, analytics and market research. In order to understand OneSignal’s use of Data, consult OneSignal’s privacy policy.

Push notifications opt-out. You can opt-out of receiving push notifications by visiting your device notification settings on your phone and then changing those settings on your device.

Interest-based advertising opt-out. You may opt-out of OneSignal advertising features through applicable device settings, such as the device advertising settings of your mobile phone. Different device configurations, or updates to devices, may affect or change how these indicated settings work.

Personal Data collected: Cookies, email address, geographic position, language, unique device identifiers for advertising (Google Advertiser ID or IDFA, for example), Usage Data and various types of Data as specified in the privacy policy of the service. Place of processing: United States.

3.1.5 Facebook

We also incorporate integrations from Facebook (Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA). Among other things, this Connect-feature is there so you can log into Film There with your Facebook profile. Please note that we generally do not have a direct impact on the amount of data that is or will be transferred to or from us through the Facebook integration, depending on your account settings. As far as we do have influence on the structure of the integration, we collect, save and process your personal data only according to applicable data protection law.

The login integration only transfers the public profile information (e.g., profile, name, e-mail address, age, occupation, place of residence, gender) specified by you, as well as your automatic account identification number that is stored by Facebook.

3.1.6 Google Maps

We also include Google Maps so you can use Film There’s location-specific features (such as location suggestions). If you use Google Maps on Film There, it means that Google is processing the IP address of your device because Google will not be able to display the map view without it. We have no influence on how Google processes the IP address.

3.1.7 Google Analytics

We also include Google Analytics, a Google web analytics program. Google Analytics allows us to analyze your use of Film There. The information that is generated is generally transferred to a Google server in the USA and stored there. With the IP anonymisation process, which we have activated, the acquired IP addresses will be shortened in advance by Google within the European Union. On our behalf, Google will use this information to evaluate the use of Film There by you and other users. Your IP address will not be merged with other Google data. You can also prevent the collection and processing of the information generated by Google Analytics by setting an opt-out cookie on the site or by disabling Google Analytics from the app or terminal’s menu.

3.1.8 Google Tag Manager

We use the Google Tag Manager by Google LLC, Mountain View, CA, USA. Google Tag Manager is a solution that allows marketers to manage website tags through a single interface. The tool Google Tag Manager itself (which implements the tags) is a cookieless domain and does not collect any personal data. The tool triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If deactivation has been made at the domain or cookie level, it will remain in effect for all tracking tags implemented with Google Tag Manager. 3.1.9 Google Ads

We also use Google Ads by Google LLC, Mountain View, CA, USA, which helps us determine how effective the clicks on our ads are with regard to the desired customer behaviour — e.g. purchases, phone calls, app downloads, newsletter subscriptions, etc.

3.1.10 Mixpanel

We use Mixpanel — a service offered by Mixpanel Inc. (Mixpanel), 405 Howard Street, Floor 2, San Francisco, CA 94105, USA to collect and analyze Applications technical and usage data.

The following information is transmitted to Mixpanel:

  • location data, such as: country, region and city, obtained by converting the IP address;
  • device info, such as: device ID, device model and type, name and version of device operation system, device settings and language settings;
  • identifiers and results of operations performed, such as: requests, messages, bookings, refunds;
  • Application version.

Data transmitted to Mixpanel is not additionally stored or transferred to other services or resources. 3.1.11 Stripe

For online payments (for example if you book or rent out a location), we use the payment services of Stripe (https://stripe.com). For payments made through Stripe we will have access to limited information including your name, card type and the card’s last 4 digits, however, do not have access to your full debit/credit card information. Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available for payments processors. When connecting your Stripe account to our platform you give us ‘read and write’ permissions that allow us to create subscriptions, customers, charges, refunds, and more in your name. We require this level of permission to enable the best possible user experience with automated payment and refund processes that can be managed within Film There. We will not use your information for any other purpose. Please view Stripe’s Privacy Policy for further information. Also, we have taken several precautions to ensure confidentiality and security of your personal information, which can be seen in Chapter 6.

3.1.12 Benchmarkmail

We use Benchmarkmail (Benchmark Email, 10621 Calle Lee, Building 141, Los Alamitos, CA 90720, USA) to send you newsletters. If you sign up for our newsletter, we will collect personal information like your e-mail address or your name. That information may be transmitted to Benchmarkmail to deliver our services and send you newsletters.

Newsletter opt-out. You can opt-out of receiving our newsletter by clicking the opt-out link that is at the bottom of each mail.

3.2 Other Members of Film There with whom you may want to make a booking or interaction

As a Host we share your name, your location name and other Submitted Information you make publicly available on Film There, decide to share using the booking or messaging function or otherwise you authorise us through the site functionality to facilitate communication. If you as a Host accept a request, the exact address of the booked Listing will be sent to the Hirer. As a Hirer we may share your Name and other Submitted Information you make publicly available on Film There.

You can recommend Film There to your friends or share, for example, a location or profile, via social media integrations, e-mail, SMS and WhatsApp and others. We would like to point out to you, however, that if you do this, your respective contact details and the recipient of your choice as well as your recommended content will be transmitted to the selected service provider, over which we have no influence. Please inform yourself about the nature and extent of this data transfer with the corresponding service provider (e.g., your e-mail or mobile service provider, WhatsApp etc.).

4. Storage and Transfers outside the European Economic Area (“EEA”)

We aim to transfer and store all your data within the European Economic Area (EEA), but where necessary and in order to operate Film There and our Site and to otherwise deliver our Services, we may transfer personal information to countries outside the EEA.

Non-EEA countries do not have the same data protection laws as the EEA. In particular, non-EEA countries may not provide the same degree of protection for your personal information, may not give you the same rights in relation to your personal information and may not have a data protection supervisory authority to help you if you have any concerns about the processing of your personal information. However, when transferring your personal information outside the EEA, we will comply with our legal and regulatory obligations in relation to your personal information, including having a lawful basis for transferring personal information and putting appropriate safeguards in place to ensure an adequate level of protection for the personal information.

We will take reasonable steps to ensure the security of your personal information in accordance with applicable data protection laws.

When transferring your personal information outside the EEA, we will ensure that, where required by applicable law, at least one of the following safeguards is implemented:

4.1 Adequacy decisions

We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission. For further details, see the European Commission adequacy decisions.

4.2 Model clauses

Where we use certain service providers, we may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe. For further details, see the European Commission standard contractual clauses.

4.3 EU-U.S. Privacy Shield

Where we have partners or suppliers based in the US, we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between Europe and the US.

Where we have given you (or where you have chosen) a password that enables you to access certain parts of our Apps or Sites, you are responsible for keeping this password confidential. We kindly ask you not to share a password with anyone.

Please contact us if you would like further information on the specific mechanisms used by us when transferring your personal data outside the EEA.

5. How long we keep your personal information

Regarding personal information we have processed in connection with the supply of Film There, our Site or our Services, we will retain personal information relevant to that supply of Services for six years from the date of supply and in compliance with our obligations under the EU General Data Protection Regulation (or similar legislation around the world). We may then destroy such files without further notice or liability. Regarding any other personal information we have processed, we will retain relevant personal information for three years from the date of our last interaction with the relevant individual and in compliance with our obligations under the EU General Data Protection Regulation (or similar legislation around the world). We may then destroy such files without further notice or liability.

If any personal information is only useful for a short period (e.g. for a specific event or marketing campaign or in relation to recruitment), we may delete it at the end of that period.

If you have opted out of receiving marketing communications from us, we will need to retain certain personal information on a suppression list indefinitely so that we know not to send you further marketing communications in the future.

6. Confidentiality and security of your personal information

We maintain up-to-date technical measures to ensure data security, in particular to protect your personal data when it is being transferred, as well as from interference from third parties. To secure the personal information you provide, we use Transport Layer Security (TLS), which encrypts the information you provide. Also, we have implemented information security policies, rules and technical measures to protect the personal information that we have under our control from:

  • unauthorised access;
  • improper use or disclosure;
  • unauthorised modification; and
  • unlawful destruction or accidental loss.

All our employees and data processors (i.e. those who process your personal information on our behalf, for the purposes listed above) who have access to and are associated with the processing of personal information are obliged to respect the confidentiality of the personal information of all users of Film There, our Site and our Services.

7. Your rights

You have the right to request information about the processing of your personal data by us at any time. We will explain our data processing practices to you and provide an overview of the personal data that we hold on you.

If data stored with us is incorrect or out-of-date, you have the right to have this information corrected.

You can also request the deletion of your data. If the deletion is not possible e.g., for legal reasons, the data will be blocked, so that it is only available for such purposes.

You can also restrict the processing of your data, e.g. if you believe that the information we hold is incorrect.

You have the right to data portability for any data where we have relied on consent to collect it (as indicated above). This means that we will send you a digital copy of such personal data if you request it.

In addition, you have the right to object to data processing in certain circumstances.

To exercise your rights as described here, you can contact us using the details in paragraph 1 above. You also have the right to complain to the applicable data protection regulator at any time. You may assert this right with a regulatory authority in the Member State of your residence, your place of work or the place of alleged infringement. 8. Cookies

A cookie is a text file placed onto your device when you access our Apps or Sites. We use cookies and other online tracking devices such as web beacons, and flash object storage to deliver, improve and monitor our Sites and Apps, including in the following ways:

  • Authentication — to log you into our Sites and Apps and keep you logged in.
  • Preferences — to remember information about you such as your preferred language and configuration.
  • Analytics — to help us understand how you use our Apps and Sites, and how often, so we can improve them to deliver a better experience for our users; and to carry out research and statistical analysis to help improve our content, products and services.
  • Marketing & Social Cookies — to select ads for you in relation to other websites and platforms you may be using.

The information we obtain from our use of cookies will not usually contain your personal data. Although we may obtain information about your device such as your IP address, your browser and/or other internet log information, this will not usually identify you personally.

On our website, we display a notice alerting you to our use of cookies and other similar technologies and linking to this Policy. If you use our website, Film There or other services we will assume that you consent to our use of cookies or similar technologies for the purposes described in this Policy.

Please note that, if you choose to disable cookies or similar technologies on your device, you may be unable to make full use of our Website, Film There and our other Services.

We work with third parties who may also set cookies on our website, for example Google Analytics, Google Adsense, Facebook, Twitter and YouTube which we use to display video content, enable social networking functionality and sharing, to deliver ads, send notifications and to monitor how visitors use our Apps and Sites. These third party suppliers are responsible for the cookies they set on your device. For further information, please visit the website of the relevant third party.

9. Right of revocation and opposition

In accordance with Article 7 (2) of the GDPR, you have the right to revoke any consent given to us at any time. If you do this, we will not continue any data processing based on such consent for the future. If you would like to exercise your right of revocation you can contact us using the details in paragraph 1 above.

10. Amendment to our Privacy Policy

We reserve the right to change our Privacy Policy at any time. We will notify you of changes in advance, endeavoring to give you four weeks’ prior notice. If you do not object to the validity of the amended Privacy Policy within four weeks or if you use Film There after the Privacy Policy has been updated, or otherwise confirm the amended Privacy Policy, you are deemed to have agreed to be bound by the updated Privacy Policy. If you do not wish to accept the updated Privacy Policy you should not continue to use Film There.

11. Acceptance of these terms

By using Film There, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
